One month after a court ruling regarding the leadership of the A Ti’a i mua trade union in Tahiti, legal counsel for Jean-Marie Pico Yan Tu has issued a statement clarifying his client’s position. The dispute follows the removal of Avaiki Teuiau from her role as secretary general, a move initiated by Yan Tu through an extraordinary executive board meeting on June 29.
Following the leadership change, Teuiau sought legal intervention. In response, the judge for summary proceedings, Hélène Bigot, ordered the suspension of the effects of the June 29 decisions, including the revocation of the previous executive secretariat and the appointment of a new one. The court further ordered Yan Tu to cease using the title of secretary general, to refrain from entering union premises, and to stop modifying access to those facilities.
Despite the court order, Yan Tu’s attorney argues that the ruling did not confirm Teuiau as the secretary general. The attorney stated that the judge only suspended the effects of Yan Tu’s election, which was held on June 29. According to the legal counsel, Yan Tu remains the secretary general because his election has not been formally annulled by a court, noting that no substantive legal action has been initiated to challenge the validity of the election.
The attorney emphasized that the summary ruling is provisional and lacks the authority of a final judgment on the merits of the case. He added that the decision could be modified if new circumstances arise. Describing the current situation as complex, the attorney indicated that the matter is expected to be resolved by union members during a congress scheduled to take place in the coming weeks.
