Judge Awards $35,000 for Inhumane Detention Conditions in Firearm Case

In a significant ruling, a High Court judge has awarded $35,000 in compensation to Patrick Trumpet, who endured unsanitary conditions during his week-long detention on firearm-related charges in 2017. Justice Devindra Rampersad emphasized that while the police had valid grounds to arrest Trumpet, the manner in which he was held was deemed ‘oppressive.’

Evidence presented during the hearing revealed that Trumpet was confined in a cell for eight days without access to basic hygiene facilities, including the inability to bathe. This lack of care raised serious concerns regarding the treatment of detainees under such circumstances.

Although the judge dismissed allegations of false imprisonment and malicious prosecution, he granted Trumpet $20,000 in damages along with an additional $15,000 for exemplary damages. The ruling underscores a critical point: regardless of the charges against an individual, they must be treated humanely while in custody.

Justice Rampersad’s decision serves as a reminder of the importance of maintaining humane conditions for all detainees, reinforcing that even those accused of serious crimes are entitled to basic rights and dignity during their detention.
