In its current interpretation, peace bond won’t be signed by AISA: Neha

AISA president Neha appeared before the Special Executive Magistrate (SEM) at the Mandir Marg police station on Saturday, a day after the Delhi High Court dismissed her challenge to a police showcause notice. The notice, issued on 17 October under Section 126 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), directed Neha to sign a Rs 10,000 peace bond with one surety to maintain peace during an inquiry. Neha had argued that the notice was vague, factually incorrect and lacked evidence of a likelihood that she would breach peace. The High Court rejected her plea, holding that the notice met legal requirements and that even a single incident could justify preventive proceedings if it suggested an apprehension that the person might cause further disturbances. Following the court’s decision, the SEM provided Neha’s counsel, Abhik Chimni, with the documents that formed the basis of the police allegation. The magistrate has given Neha until 29 October to reply. “We will examine the documents before the next hearing,” Chimni told reporters. Before heading to the SEM court, Neha held a press conference at the Press Club of India, where she criticized the concept of peace bonds. “Signing the peace bond would squander the right to democratic dissent,” she said. “It is important that peaceful demonstrations are not declared a breach of peace. In its current interpretation, the peace bond will not be signed by AISA.” When Neha arrived at the Mandir Marg police station around 2 pm, about 50 people were protesting against her, chanting slogans. Her car was escorted inside by a Delhi Police security vehicle. She left the station at approximately 4:30 pm. The showcause notice was part of police action following protests against Chief Election Commissioner Gyanesh Kumar over allegations that votes were deleted through the Special Intensive Revision (SIR) of electoral rolls. Neha had been detained at Mandi House on 16 October while en route to the “Lehra Do Tiranga” march at Connaught Place and was released the following day.
