Enfrenta industria incertidumbre por checado digital; prevén ajustes en supervisión de nóminas

Tijuana, B.C. – The maquiladora sector in Tijuana is preparing for the upcoming implementation of an electronic attendance system required by a recent reform to the Federal Labor Law. The change, which was published on May 1, adds fraction XXXIV to Article 132 of the law, obligating employers to record each employee’s start and end times electronically and to provide that information to the labor authorities when requested. The Secretaría del Trabajo y Previsión Social (STPS) will issue detailed guidelines that will set the applications and exceptions for the new system. According to Fernando Becerra, president of the Asociación de Recursos Humanos de la Industria de Tijuana (Arhitac), many companies already use electronic check‑in, but they must determine which of their current software solutions will meet the new requirements and what adjustments will be necessary. “Many companies already have electronic check‑in… the challenge will be to determine which systems will comply and what adjustments the providers will need to make to meet the norm,” Becerra said. The reform eliminates the traditional exemptions that applied to trust positions that did not record entry or exit times. All personnel will now be subject to mandatory electronic recording. Inspectors will use the records to verify payroll, including the correct payment of double, triple, and holiday hours. “It will be something they will ask for in the inspections… the check‑in will be fundamental in the national change for the reduction of the work week,” Becerra added. He also noted uncertainty about how the new system will interact with the 46‑hour work week, particularly for night and mixed schedules. Arhitac is awaiting secondary regulations that will clarify these gaps. “Today companies are in uncertainty… depending on how the requirements are published, we will know the real impact on the records and on plant operations,” Becerra concluded.
