Energy Department Asks Full Court to Rehear Michigan Coal Case

The U.S. Department of Energy (DOE) has petitioned the full U.S. Court of Appeals for the Sixth Circuit to rehear a case concerning the regulation of the Campbell coal-fired power plant in Michigan. The legal dispute centers on the scope of the Federal Power Act and the extent of the DOE’s authority in relation to state and utility-level decision-making. In its filing, the department argued that the Federal Power Act “does not require DOE to subordinate, delay, or defer to the actions (or inaction) of states or utilities.” The petition seeks an en banc review, requesting that the entire bench of the Sixth Circuit reconsider a previous ruling that impacted the department’s regulatory oversight of the facility. The DOE maintains that its interpretation of the law is essential for maintaining federal authority over energy infrastructure, asserting that the statute does not mandate that federal regulators yield to local or state-level energy policies. The case remains a focal point for legal experts monitoring the balance of power between federal energy regulators and state utility commissions.
