KPK Usulkan Kewenangan Rampas Aset Pejabat Tak Tercantum di LHKPN

Jakarta, 26 October 2026 – The Deputy Chair of Indonesia’s Corruption Eradication Commission (KPK), Johanis Tanak, presented a draft law on asset seizure related to criminal conduct (RUU Perampasan Aset) to journalists in Jakarta on Monday. The proposal would allow the state to confiscate the assets of public officials whose wealth is not fully disclosed in their mandatory Asset and Wealth Disclosure Reports (LHKPN). According to Tanak, if a public official reports a lower value of assets in their LHKPN than the actual value, the state may seize the excess assets. He also suggested that officials who are required to file an LHKPN but fail to do so would be subject to asset seizure under the new law. “If a public official is required to report an LHKPN but does not do so, the state can seize their assets based on the Asset Seizure Law,” Tanak said. The deputy chair also proposed a mechanism for officials who contest the seizure. He argued that including such a mechanism would encourage accurate reporting. “If this is regulated in the Asset Seizure Law, public officials will be less likely to submit false LHKPNs. They will report correctly,” he said. Tanak maintained that the name “Asset Seizure Law” should remain unchanged, noting that the term “seizure” is already used in the Anti-Corruption Law (UU Tipikor). He cited Article 18 of Law No. 31/1999, as amended by Law No. 20/2001, as an example of the term’s usage in anti-corruption legislation. The draft law has not yet been passed and remains under discussion within the KPK and relevant legislative bodies.
