How Historical Documents Can Help Decide Iceland’s Common Land Disputes

Historical documents have sometimes proved decisive in resolving Icelandic common land disputes, according to a presentation highlighted by the National Archives of Iceland. Their practical importance was among the subjects explored at the institution’s Research Day on September 24, 2026.

District Court Judge Þorsteinn Magnússon addressed the significance of historical documents in common land cases. The archives’ account says his presentation examined how such records have helped determine outcomes in some disputes. It does not identify individual cases or describe the documents involved.

The presentation formed part of a programme devoted to public administration and archives, organised around the publication Public Administration and Archives: The Practice of Records Preservation and Records Management. Authors approached the subject from historical, administrative and legal perspectives.

Opening the event, National Archivist Hrefna Róbertsdóttir discussed the administrative and cultural role of public archives and the importance of securely preserving records for future generations.

Other presentations examined how preservation obligations have developed. Kristjana Kristinsdóttir reviewed changes following Act No. 66/1985 on the National Archives and efforts to improve public-sector records management. Njörður Sigurðsson discussed changes to Alþingi’s record transfer obligations in 2014 and 2019.

The programme also addressed the relationship between archival preservation and personal information. Þórður Sveinsson, Chief Legal Counsel at the Icelandic Data Protection Authority, examined the interaction between data protection legislation and public archives law, including preservation of personal data and the rights of the people concerned.

Together, the subjects placed historical records within everyday questions of public responsibility and legal rights. The land-disputes presentation offered a particularly concrete example: documents preserved from the past can remain consequential when courts resolve questions in the present.
