**Madagascar’s Constitutional Court Rejects KINTANA’s Call for Dissolution of National Assembly**
*Antananarivo, 26 August 2026* – The Haute Cour Constitutionnelle (HCC) ruled that a petition filed by the political party KINTANA seeking the dissolution of Madagascar’s National Assembly is inadmissible.
The request, submitted on 18 August 2026 by KINTANA’s secretary‑general Marcel Ralainirina, alleged a “institutional blockage” between the Executive branch and the National Assembly. KINTANA asked the Court to recognize this blockage and to recommend that the President of the Republic dissolve the legislature.
In its deliberation, the HCC identified three grounds for rejecting the petition:
1. **Lack of standing** – Article 118 of the Constitution limits direct petitions to the Court to specific authorities and bodies. The Court noted that a political party is not among those authorized to bring such a request, regardless of its legal status.
2. **Jurisdictional limits** – The Court affirmed that the power to dissolve the National Assembly is not within its competence. While KINTANA cited Article 68 of the Constitution, the HCC clarified that the authority to dissolve the Assembly is vested in the President under Article 60, to be exercised after consultation with the Prime Minister and the presidents of the two parliamentary chambers.
3. **Constitutional constraints** – Referring to its own decision of 14 October 2025 and to Article 53 of the Constitution, the HCC explained that during the period between a presidential vacancy and the inauguration of a new president, certain constitutional provisions—including the dissolution power in Article 60—cannot be applied. Consequently, the interim authority acting as the President’s substitute is barred from dissolving the Assembly.
Given these procedural and substantive deficiencies, the HCC declared the petition inadmissible. The decision will be formally notified to KINTANA and published in the *Journal officiel de la République*.
