Attorney General and Minister of Legal Affairs, Anil Nandlall, SC, has responded to allegations from certain opposition members regarding the Former Presidents’ Benefits and Other Facilities Bill of 2026. Nandlall asserts that the proposed legislation is not aimed at benefiting any specific individual. During his program, Issues in the News, he characterized the opposition’s claims as a deliberate attempt to mislead the public about the bill’s purpose.
Nandlall stated, “I see in certain political quarters that a deliberate campaign has been deployed designed to mislead, distort, and scandalise the former President’s Benefits and Other Facilities Bill of 2026.” He clarified that the bill is not a new concept but rather a replication of the Former Presidents’ Benefits and Other Facilities Act of 2009, which was established to clearly outline the benefits available to former Presidents after their tenure.
He explained that prior to the 2009 law, there was no established legislative framework governing the benefits for former Presidents, despite some having received similar benefits. The 2009 law aimed to codify and clarify these benefits, ensuring they were not subject to the discretion of any sitting government.
Nandlall noted that the APNU+AFC administration repealed the 2009 Act in 2015, replacing it with new legislation that could not retroactively affect benefits already granted to former Presidents. He criticized the 2015 legislation for failing to achieve its intended purpose, stating, “They passed a law that they told the people would rescind all the benefits that former Presidents were receiving, but the law could not operate retroactively. So the law had no teeth.”
He further accused the previous government of targeting former PPP Presidents, indicating that the law primarily affected former President David Granger upon his departure from office. Nandlall also referenced the Hamilton Green Pension Bill, enacted in 2017, which provided benefits to a former Prime Minister long after his term ended.
The Attorney General emphasized that the current bill aims to ensure fairness and consistency in the treatment of all former Presidents. He stated, “The 2026 Bill is simply intended to remedy that deplorable state of affairs and to put every former President on even keel, including former President David Granger.” Nandlall dismissed claims that the bill is designed to benefit President Dr. Irfaan Ali after his term, asserting that it would apply equally to all former Presidents.
He concluded by stating, “The 2026 Bill is intended to restore the dignity to the office of a former President and to bring certainty and equity to the entitlements of that office to ensure that all former holders of that office enjoy equal treatment.” Nandlall reiterated that the Government’s goal is to ensure consistent application of benefits associated with the office, regardless of political affiliation, stating, “What we have done here is a package that will apply to all former Presidents.”
