Pas rënies së Vuçiqit, Prokuroria serbe rihap çështjen e Radoiçiqit – “Pse u la i lirë pas sulmit në Banjskë?”

The Serbian Public Prosecutor’s Office, under the supervision of a commission established by Republic Public Prosecutor Zagorka Dolovac, has initiated a review of the legal proceedings concerning Milan Radoičić. Radoičić is the primary suspect in the organization of the September 2023 armed attack in Banjska, in northern Kosovo. The commission is specifically examining the circumstances surrounding the decision not to remand Radoičić in custody following his initial questioning by the Higher Public Prosecutor’s Office in Belgrade. According to reports from the portal nova.rs, the prosecutor at the time, Nikola Pantelić, requested detention based solely on the risk of flight. However, the court deemed this argument insufficient, noting that Radoičić had surrendered voluntarily. The review is expected to investigate why the prosecution failed to cite other potential grounds for detention, such as the risk of repeating the criminal offense, the potential for witness tampering, or the impact on public order. Since the incident, Pantelić has been promoted to the position of head of the Higher Public Prosecutor’s Office in Pančevo. Following the initial hearing, the presiding judge rejected the prosecution’s request for a 30-day detention, citing Radoičić’s personal and property ties to Belgrade, his voluntary surrender, and the surrender of his passport as sufficient guarantees for his presence during the proceedings. Instead, the court imposed restrictive measures, including a ban on leaving Serbia without court approval, the confiscation of his passport, and a mandatory requirement to report to the police. He was also prohibited from traveling to Kosovo. The oversight commission operates under a mandatory instruction issued by Zagorka Dolovac to all 87 public prosecutor’s offices in Serbia. The directive grants the commission access to case files involving crimes against constitutional order, national security, and official duty, among others. Failure to comply with this directive is classified as a disciplinary offense. The attack in Banjska occurred on September 24, 2023, resulting in the death of Kosovo Police Sergeant Afrim Bunjaku. During the subsequent exchange of fire, three members of the armed group—Stefan Nedeljković, Bojan Mijailović, and Igor Milenković—were also killed. Radoičić subsequently claimed responsibility for organizing the group. Through his lawyer, Goran Petronijević, he stated that he had traveled to northern Kosovo to encourage resistance against the government of Albin Kurti, while asserting that authorities in Belgrade had no prior knowledge of his actions. While Radoičić remains at liberty in Serbia, several other individuals involved in the Banjska incident have been sentenced in Kosovo, with some receiving life imprisonment.
