Mukhito vindicated: High Court’s intervention lends weight to constitutional overreach warning

The High Court of Malawi has issued a temporary injunction halting proposed parliamentary inquiries, a move that follows warnings from Democratic Progressive Party (DPP) Secretary General Peter Mukhito regarding the scope of legislative oversight.

Mukhito had previously cautioned that the planned inquiries risked exceeding the constitutional boundaries between parliamentary oversight and formal investigations. His remarks had drawn criticism from some observers who characterized his stance as political interference.

The court’s decision to pause the inquiries pending a judicial review provides a legal framework to examine the constitutional limits of the parliamentary process. The intervention serves as a significant development in the ongoing debate regarding the separation of powers and the extent of authority held by parliamentary committees in Malawi.
