Guyana: Police Sergeant Cleared of Drug Theft Claim

A Police Detective Sergeant in Guyana, Elfannando Newman, has been acquitted of charges related to the alleged theft of marijuana. The ruling was made by Senior Magistrate Sunil Scarce, who determined that the prosecution did not present enough credible evidence to support the charge of larceny by a public officer. This decision concludes a case that has been ongoing for approximately four years.

The charge against Newman was filed by the Special Organised Crime Unit (SOCU) in June 2022. Prosecutors alleged that he stole around seven kilograms of marijuana that had been entrusted to him for safekeeping at the Timehri Police Station between February 27 and March 1, 2021. The allegations originated from a police interception of a vehicle carrying an estimated 45 to 50 pounds of marijuana.

Investigators claimed that the narcotics were handed over to Newman, but he allegedly recorded only 6.8 pounds and did not properly lodge the entire quantity. Based on this, SOCU charged him with larceny, asserting that the missing marijuana was stolen to hinder the potential conviction of the individual who claimed ownership of the drugs.

Throughout the proceedings, Newman maintained his innocence and consistently denied the allegations. His attorney, Eusi Anderson, stated that the court found the prosecution’s evidence to be insufficient, inadequate, and unreliable. Following the ruling, Anderson expressed hope that Newman would be permitted to return to his duties within the Guyana Police Force.

This case has been noted as one of the more unusual police-related prosecutions in recent years, with the court ultimately concluding that the evidence against the officer was not strong enough to warrant a conviction.
