Estate Planning Discussion Highlights Importance of Having a Will
A recent TikTok Live discussion has sparked renewed attention to the importance of estate planning, with legal professionals stressing the consequences of dying without a valid will in Trinidad and Tobago.
During the discussion, it was explained that when a person dies intestate—without leaving a legally valid will—their estate is distributed according to the provisions of the Succession Act rather than their personal wishes. This means that the law determines who inherits assets based on family relationships, regardless of the quality of those relationships or the deceased’s intentions.
Participants noted that this can produce outcomes many families do not expect. For example, children may inherit equal shares of an estate even if their relationships with the deceased differed significantly. Similarly, relatives who had little or no contact with the deceased may still be entitled to inherit under the law, while an unmarried or engaged partner could receive nothing if they are not legally recognised as a beneficiary under the applicable rules.
The discussion highlighted how these situations can become a source of conflict, leading to lengthy legal disputes, strained family relationships, and delays in administering an estate.
Legal experts encouraged members of the public to prepare a clear and legally valid will to ensure that their assets are distributed according to their wishes. A properly drafted will can provide certainty for loved ones, reduce the likelihood of disputes, and help simplify the estate administration process.
The conversation served as a reminder that estate planning is not only for the wealthy but for anyone who wishes to protect their family, preserve their legacy, and ensure their final wishes are respected.
