Rajkumar Ramroop, a retired prison officer from Trinidad and Tobago, is currently in a legal dispute with the Public Service Commission (PSC) and the Attorney General. Ramroop, who was on the Order of Merit list for promotion between 2008 and 2010, was compulsorily retired in 2019. However, four other officers on the same list were promoted just 21 days after his retirement. An assessment between 2011 and 2014 placed Ramroop third, but the PSC maintains that since he had retired, he was no longer under their purview. The PSC’s refusal to promote Ramroop, despite evidence that other retired officers were promoted with retroactive dates, has resulted in a court case. The High Court found that the PSC’s decision breached principles of natural justice, procedural fairness, and violated Ramroop’s constitutional right to equality of treatment. The court ordered the PSC to reconsider Ramroop’s promotion and to determine an effective date, although the outcome of this reconsideration remains uncertain.
