Officer Loses Pension Appeal in Privy Council

Chad Antoine, a former officer of the Trinidad and Tobago Police Service (TTPS), has lost his final bid to secure his pension. The Privy Council denied his appeal, which was based on an incident that took place in 2000. According to reports, Antoine allegedly forced a couple to engage in sexual activities in his presence, which led to his dismissal from the police service following a disciplinary tribunal’s guilty verdict. Despite multiple legal challenges since his dismissal, Antoine’s claims have been consistently dismissed. He argued that he was denied equal treatment under the law as another officer with disciplinary offences had been granted pension benefits. In 2020, the High Court dismissed his claim, ruling that under the Police Service Act, officers can have their retirement benefits withheld if their service is broken due to suspension or dismissal. The Court of Appeal and the Privy Council also dismissed his claims, effectively putting an end to the decades-long legal battle and confirming that Antoine will not receive pension or gratuity benefits after his dismissal.
