Know Your Rights: Vehicle Wrecking Under Chapter 48:50

Understanding your rights in the event of vehicle wrecking is essential. Under Section 108(1) of the Motor Vehicle & Road Traffic Act Chap. 48:50, if your vehicle is being towed but hasn’t yet been moved and you arrive on the scene, the police are obligated to release your vehicle to you. However, if other offences are discovered, they still have the right to issue you a ticket or proceed with legal action. This applies when a car has been hooked up or is in the process of being hooked up to a wrecker, but has not been moved from where it was parked. If the driver or person in control of the vehicle appears and claims the vehicle simultaneously, the police officer must release the vehicle, issue ticket(s) for offences committed, or prosecute the driver or person in charge for any detected offences.
