High Court Upholds Homeland Security Minister’s Decisions on Sealey’s Preventive Detention Order

The High Court has dismissed a judicial review challenge brought by Lloyd Sealey against the Minister of Homeland Security concerning his detention under a Preventive Detention Order (PDO). This order was issued during a State of Public Emergency in Trinidad and Tobago.

Justice Christopher Sieuchand delivered the ruling, affirming that the Minister acted lawfully when he issued and maintained the PDO. This decision came despite a Review Tribunal recommending Sealey’s release, citing insufficient cause for continued detention.

The Minister defended the PDO as a necessary measure given the national security context, pointing to intelligence about escalated organized crime and threats to public safety. Evidence presented linked Sealey to a criminal enterprise involving human trafficking and narcotics, although these claims have not led to criminal convictions.

During an investigation, authorities executed search warrants at a property known as ‘The Mansion,’ detaining 54 individuals, including foreign nationals. The Minister argued that these actions were appropriate given the State of Public Emergency, which justified extraordinary measures.

Justice Sieuchand concluded that the Minister’s decision was reasonable and within the emergency powers’ scope. While the Review Tribunal advised release, the court found the Minister justified in making an independent decision. Sealey was ordered to cover a portion of the legal costs incurred by the Minister’s defense.
