Guyana: New Bill Aims to Address Deterioration of Seized Assets in Guyana

A new piece of legislation is set to be introduced in the National Assembly of Guyana this week, aiming to tackle the issue of seized vehicles, boats, and other properties deteriorating while criminal cases are pending. The Depreciating Property Sale Order Bill of 2026 is one of six bills scheduled for discussion during the National Assembly meeting on June 5.

Attorney General and Minister of Legal Affairs Mohabir Anil Nandlall stated that the proposed legislation was developed in collaboration with the Regional Security System (RSS) and the Caribbean Financial Action Task Force (CFATF), with the intention of implementing it across the Caribbean region.

Nandlall highlighted that criminal cases involving customs, narcotics, and anti-money laundering offences often result in the seizure of vehicles, boats, gold, and other properties, which can remain in storage for extended periods. He noted that these assets frequently deteriorate due to inadequate storage conditions, leading to significant depreciation in value by the time legal proceedings conclude.

Under the proposed legislation, the State would be permitted to apply to the court for authorization to sell seized property before it deteriorates. The proceeds from such sales would be placed in an interest-bearing account until the legal matters are resolved.

Nandlall emphasized that state agencies would not have the authority to sell property independently; they would need to obtain a valuation, initiate court proceedings, and notify the property owner. The court would retain the power to make the final decision regarding the sale.

If enacted, the legislation aims to reduce the number of vehicles and other assets that deteriorate in storage facilities managed by agencies such as the Guyana Revenue Authority (GRA), the Customs Anti-Narcotic Unit (CANU), and the Guyana Police Force. Nandlall described the measure as a significant step towards addressing a persistent issue within the legal system.
