Guyana: Court Allows Mahdia Fire Lawsuit to Proceed

Parents of children who died in the Mahdia Secondary School dormitory fire have secured a legal victory after Chief Justice Navindra Singh dismissed applications that sought to strike out their claims against the State. This ruling allows the parents’ case to move forward, enabling a judicial examination of allegations regarding violations of constitutional rights and negligence by the State in relation to the tragic incident that resulted in the loss of several students.

Attorney-at-Law Darren Wade, representing the parents, stated that the families argue their deceased children were denied constitutional protections and that the State is responsible for the circumstances surrounding the fatal fire. Additionally, the families are contesting compensation agreements they reportedly signed after the tragedy, which were valued at approximately $5 million each. The parents assert that they entered into these agreements without independent legal advice.

Attorney General Anil Nandlall had attempted to have the legal proceedings dismissed before a full hearing could occur. However, Chief Justice Singh determined that the issues raised by the parents could not be resolved merely by reviewing the compensation agreements and instead necessitated a thorough examination of the evidence. The Chief Justice remarked, “I believe we have now a mixed bag of substantial questions of law and fact that require much more than an agreement waived to determine all of these issues.”

This ruling means that the court will now investigate the broader circumstances surrounding the claims, including allegations of negligence and breaches of constitutional rights. As part of the decision, the Chief Justice ordered the proceedings to be converted into Statements of Claim and established timelines for the filing of necessary legal documents. This advancement formally progresses the matter into the next stage of litigation, potentially becoming one of the most closely monitored civil cases arising from the Mahdia dormitory disaster.
