Guyana: Attorney General Encourages Local Councils to Address Squatting

Attorney General and Minister of Legal Affairs Anil Nandlall has called on Regional Democratic Councils (RDCs) and Neighbourhood Democratic Councils (NDCs) in Guyana to utilize the legal powers available to them in addressing the issue of squatting. During a recent appearance on the Issues in the News programme, Nandlall emphasized that local authorities possess the authority to remove encroachments from government reserves and state lands.

Nandlall encouraged councils to consider hiring legal professionals to provide ongoing legal advice and assist in the enforcement of laws related to land occupation. He stated, “They are to use those powers, serve notices, take those persons to court or use the powers to demolish as they are being erected.”

The Attorney General highlighted that squatting continues to be a significant issue in the country and reiterated the government’s commitment to a zero-tolerance approach towards illegal land occupation. He acknowledged that while some individuals are awaiting the allocation of house lots, this situation does not justify the illegal occupation of land.

According to Nandlall, the government is investing substantial resources into land development before it is allocated to citizens. He also pointed out that squatters lack legal protection, stating, “The rightful owner… can by self-help demolish your property and eject you… and they don’t have to get a court order.”

Nandlall further noted that illegal occupation of land can cause delays in public infrastructure and development projects. He urged citizens to pursue land through the appropriate channels to avoid legal complications.
