Court of Appeal Upholds Nullification of $850M Arbitration Award to Construtora OAS

In a detailed and consequential ruling, the Court of Appeal in Trinidad and Tobago has upheld the nullification of an $850 million arbitration award initially granted to Construtora OAS. This decision effectively dismisses an appeal by the Brazilian construction giant, which was seeking to reverse an earlier High Court decision that nullified the arbitration award related to the construction of the Point Fortin Highway extension.

The arbitration award, initially favorable to Construtora OAS, arose from a contractual dispute over the highway extension project. The project’s arbitration process became mired in controversy due to procedural and substantive legal errors highlighted by the Trinidadian judges. They noted that the arbitration tribunal had made significant errors in their handling of the case, leading to a fundamental miscarriage of justice.

Consequently, the case has been directed back to the London Court of International Arbitration for reassessment.
