A High Court judge has awarded $500,000 in compensation to a student after finding that actions by the Ministry of Education resulted in years of disrupted schooling and hardship.
The case centered on the student being effectively left out of the formal education system for a period of time, after decisions taken by the ministry prevented him from continuing his studies in a normal and consistent manner. The court heard that despite the situation being known, there was no timely or adequate intervention to ensure that the student remained engaged in the education system.
As a result, the student experienced a prolonged gap in schooling during critical developmental years. The court noted that this not only affected his academic progress but also had wider emotional and psychological implications.
In delivering the ruling, the judge was strongly critical of the ministry, pointing to serious failures in how the matter was handled. The court found that the student’s constitutional rights, including access to education, were breached due to the ministry’s inaction and improper handling of the situation.
The judge emphasised that state institutions have a duty to protect and support students, particularly when challenges arise that threaten their ability to continue their education. The lack of urgency and effective response in this case was described as unacceptable, especially given the long period over which the issue persisted.
The $500,000 award was granted as compensation for the hardship suffered, the disruption to the student’s education, and the long-term impact on his life opportunities. The ruling also serves as a reminder that public authorities can be held accountable when their actions fall short of required standards.
