Lawyers Andrew Ford and Adam Rasul of the Holborn Adams firm have announced that they are initiating a judicial review to challenge the United Kingdom’s request to extradite Andrew and Tristan Tate from the United States.
The attorneys argue that the extradition should be postponed until the ongoing criminal proceedings in Romania are concluded. They cite a March 2024 Romanian court decision that approved the extradition of the brothers to the UK, but only after the Romanian judicial process had finished.
Ford has stated that an extradition directly from the United States to the United Kingdom, while Romanian cases remain active, would impede the brothers’ ability to prepare their defense. This position reflects the lawyers’ view and is not a judicial ruling.
Andrew Tate, 39, and Tristan Tate, 38, hold dual American and British citizenship. They were arrested in Miami in July after the UK requested their extradition to face charges that include rape and facilitating the sexual exploitation of minors. Both brothers deny the allegations.
A federal court in Miami recently denied the brothers’ request for release pending extradition. Judge Lauren Louis cited a significant risk of flight as the reason for the denial.
The United States Department of State is reviewing the UK’s extradition request under the extradition treaty between Washington and London. The final decision on extradition will be subject to judicial review in the United States.
Meanwhile, Romanian authorities have recently indicted Andrew Tate for complicity in child trafficking and money laundering, and Tristan Tate for the same offenses. The legal situation therefore involves three jurisdictions: Romania, where criminal proceedings are underway; the United States, where the brothers are currently detained; and the United Kingdom, which is seeking their extradition for trial.
