**Varna Administrative Court Halts Legal Proceedings Initiated by “Forest Club Varna”**
The Administrative Court in Varna has suspended legal proceedings initiated by the company “Forest Club Varna” regarding the disconnection of electricity and water services in the “Baba Alino” and “Alen Mak” localities. The court cited procedural irregularities and non-compliance with legal requirements as the basis for the decision.
**Dispute over transformer station in “Baba Alino”**
The court has stayed a case filed by “Forest Club Varna” OOD against an order issued by the head of the Regional Directorate for National Construction Control (RDNSC) in Varna. The contested order mandates the removal of a transformer station (BKTP type) located in the “Baba Alino” area.
Magistrates identified irregularities in the complaint under the Administrative Procedure Code (APC). The court has issued instructions to the plaintiff and the administrative body to rectify these deficiencies. Failure to comply within the specified timeframe will result in the dismissal of the complaint and the termination of the judicial proceedings.
**Dispute over utility services in “Alen Mak”**
Separately, the court has suspended a case concerning the disconnection of electricity and water in the “Alen Mak” area. This case was initiated by “Forest Club Varna” OOD through a negative declaratory action, challenging the forced interruption of utility services based on Order No. 2774/01.09.2025 issued by the Municipality of Varna.
The filing included a request for an interim measure to halt the enforcement of the order and restore power and water supplies. Following an official review, the court determined that the filing did not meet legal requirements for regularity. The plaintiff has been given a deadline to address these issues, failing which the proceedings will be terminated.
In connection with this case, the court has ordered the Director of the “Security Management and Public Order Control” department at the Municipality of Varna to provide documentation confirming whether the order has been served, whether it has entered into force, and whether it has been subject to appeal.
